Terms of Service

These Terms of Service ("Terms") govern your access to and use of the TokenFast website, API, and related services (collectively, the "Service") provided by TokenFast, Inc. ("we," "our," or "us"). By accessing or using the Service, you agree to be bound by these Terms.

1. Eligibility

You must be at least 18 years old and capable of forming a binding contract to use the Service. By using the Service, you represent that you meet these requirements. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Account Registration

You must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your account credentials and API keys. You are responsible for all activities that occur under your account. You must notify us immediately of any unauthorized access.

3. API Usage

3.1 License Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service via our API for your internal business or personal purposes.

3.2 API Keys API keys are personal to your account and must not be shared, sold, or transferred to third parties. You are responsible for all usage and charges incurred through your API keys. If you suspect an API key has been compromised, revoke it immediately via your dashboard.

3.3 Rate Limits Your plan includes specified rate limits (requests per minute and tokens per minute). We reserve the right to throttle or temporarily suspend access if you exceed these limits or if your usage patterns threaten the stability of the Service.

3.4 Upstream Providers The Service routes your API requests to third-party model providers (e.g., Anthropic, OpenAI, Google). Your use of models is also subject to each provider's usage policies. We are not responsible for the output, accuracy, or availability of upstream models.

4. Pricing and Payment

4.1 Fees Prices for plans are listed on our website and are subject to change with 30 days' notice. All fees are in US dollars unless otherwise stated.

4.2 Billing Payments are processed securely through Stripe. By providing payment information, you authorize us to charge the applicable fees. All purchases are final unless otherwise stated.

4.3 Usage Budgets Each plan includes a usage budget. When your budget is exhausted, API requests will be declined until you purchase additional credits or a new plan. We are not liable for service interruption due to budget exhaustion.

4.4 Refunds We offer refunds on a case-by-case basis for unused credits within 14 days of purchase. Refund requests can be submitted to support@tokenfast.ai. Used credits are non-refundable.

5. Prohibited Conduct

You agree not to: - Use the Service to violate any applicable law or regulation - Generate content that is illegal, harmful, threatening, abusive, defamatory, or otherwise objectionable - Attempt to reverse-engineer, decompile, or extract source code from the Service - Use the Service to build a competing product or service - Resell, sublicense, or redistribute API access without authorization - Attempt to circumvent rate limits, usage budgets, or security measures - Use automated means to create accounts or generate API keys - Interfere with or disrupt the integrity or performance of the Service - Access the Service from embargoed countries or sanctioned entities

6. Intellectual Property

The Service, including its design, code, documentation, and branding, is owned by TokenFast, Inc. and protected by intellectual property laws. Content generated through the Service via AI models is subject to the respective model provider's terms regarding output ownership.

7. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. AI MODEL OUTPUTS MAY BE INACCURATE, BIASED, OR INCOMPLETE. YOU ARE SOLELY RESPONSIBLE FOR EVALUATING AND USING MODEL OUTPUTS.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TOKENFAST, INC. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNTS YOU PAID TO US IN THE TWELVE MONTHS PRECEDING THE CLAIM.

9. Indemnification

You agree to indemnify and hold harmless TokenFast, Inc. and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Service or violation of these Terms.

10. Termination

We may suspend or terminate your account at any time for violation of these Terms or for any other reason with reasonable notice. Upon termination, your right to use the Service ceases immediately. Sections that by their nature should survive termination will survive.

11. Governing Law

These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Delaware.

12. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated via email or a notice on the Service at least 30 days in advance. Continued use of the Service after changes take effect constitutes acceptance.
